The Supreme Court today unanimously dismissed a lawsuit filed by the Mexican government against several American gun manufacturers, including Smith & Wesson, Beretta, Colt, Glock, and Ruger.
The lawsuit could generously be called a “reach”, with the Mexican government alleging that the firearm manufacturers were somehow fomenting violence south of the border.
While it is vexing that the Court devoted the time and resources to such a frivolous case while other 2A cases could help clarify Bruen, the case yielded some very good news. On behalf of the unanimous Court, Justice Elena Kagan wrote:
“Mexico here focuses on the manufacturers’ production of “military style” assault weapons, among which it includes AR–15 rifles, AK–47 rifles, and .50 caliber sniper rifles. But those products are both widely legal and bought by many ordinary consumers.”
That’s right. A unanimous Supreme Court, in an opinion authored an Obama appointee, just went clearly on the record to state that AR-15’s, AK-47’s and .50 caliber rifles are “widely legal”, which represents HUGE NEWS!
Yes we still need the Court to take a new 2A case to make sure that the Bruen standard is clear to every court in the land. CRPA’s Duncan v. Bonta is lined up to do just that. But in the meantime, we can celebrate the victory in today’s decision!
